Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern all engagements between Victoria Waterproofing ("we", "us", "our") — operated by Subhash Chander, Sai Krushi Nagar, Sangareddy, Telangana — and clients ("you", "your") who commission waterproofing, leak repair, or related construction services.

By accepting a written quotation from us, making a payment, or allowing us to commence work on your property, you agree to these Terms. If you do not agree, do not proceed with an engagement.

These Terms apply to all project types: residential, commercial, enterprise, and materials supply. Where a specific written contract or work order exists, the terms of that document take precedence over these general Terms.

2. Quotations and pricing

All written quotations issued by Victoria Waterproofing are valid for 30 days from the date of issue. After 30 days, a quotation must be reconfirmed in writing before work commences.

Prices quoted are fixed for the scope described in the quotation. If site conditions discovered during execution differ materially from those described at the time of quotation — for example, a substrate that is significantly more deteriorated than initially assessed — we will provide a revised written quotation before proceeding with additional work. You are not obligated to accept a revised quotation.

Quotations are inclusive of materials and labour unless explicitly stated otherwise. GST is applied at the prevailing rate and itemised on all invoices.

Site inspection visits and diagnostic reports are provided free of charge. No fee is charged for the initial assessment.

3. Payment terms

Payment terms are specified in each written quotation or work order. Standard terms are:

• Mobilisation advance: 30–50% of the quoted value, due before work commences.
• Progress payment: at a milestone defined in the work order (typically substrate preparation completion).
• Balance: due on completion, before the written warranty is handed over.

Payment may be made by bank transfer (NEFT/IMPS/UPI), cheque, or cash. Full payment details are provided on each invoice.

Late payment (more than 7 days beyond agreed terms) may result in suspension of work. Victoria Waterproofing reserves the right to charge interest on overdue amounts at 1.5% per month after the due date.

All payments are in Indian Rupees (INR). We do not accept foreign currency.

4. Warranty

Every completed project receives a written warranty on Victoria Waterproofing company letterhead, signed by Subhash Chander, bearing our GSTIN. The standard warranty period is 5 years from the date of project completion.

The warranty covers:

• Leakage or seepage through the treated surface due to failure of the applied waterproofing system.
• Delamination or adhesion failure of the applied membrane or coating under normal use conditions.
• We will return to the site, assess the failure, and rectify it at no cost to you within the warranty period.

The warranty does not cover:

• Structural movement, settlement, or cracking in the substrate that occurs after our work is completed.
• Damage caused by subsequent construction, modifications, or overburden placed on the treated surface without our prior written consent.
• Negligence, vandalism, or deliberate damage.
• Areas of the surface that were excluded from scope in the written quotation.
• Projects where final payment was not made in full.

The warranty is transferable to a new property owner if the property is sold during the warranty period. Transfer requires written notification to Victoria Waterproofing within 30 days of the sale.

To make a warranty claim, contact us in writing (WhatsApp or email) with photos of the issue and your warranty reference number. We will schedule a site inspection within 5 working days.

5. Our obligations

Victoria Waterproofing agrees to:

• Complete the work described in the accepted quotation to a professional standard, using the materials specified.
• Comply with applicable Indian construction and building regulations.
• Keep the site clean and minimise disruption to occupants where possible.
• Provide a written completion certificate and warranty document on completion.
• Respond to warranty claims within the periods specified in Section 4.

6. Client obligations

You agree to:

• Provide safe and unobstructed access to the work area at agreed times.
• Ensure the work area is cleared of furniture, equipment, or other items that would obstruct work, unless clearing is specifically included in the quoted scope.
• Not apply any additional treatments, coatings, or materials to the treated surface during the warranty period without first obtaining written approval from Victoria Waterproofing.
• Make payments as agreed in the work order.
• Notify us of any defects within 30 days of discovery to preserve your warranty rights.

7. Limitation of liability

Our liability for any claim arising from a project is limited to the value of that project as stated in the accepted quotation.

We are not liable for:

• Indirect or consequential losses, including loss of rental income, business interruption, or damage to contents caused by a leak that existed before our work or that arose from causes outside our scope.
• Damage caused by delay where the delay was outside our control (weather, material supply disruption, access issues).

Nothing in these Terms limits liability for death or personal injury caused by our negligence.

8. Governing law and jurisdiction

These Terms, and any dispute arising from a project engagement or this website, are governed by the laws of India.

The courts of Sangareddy, Telangana shall have exclusive jurisdiction over any disputes that cannot be resolved by the parties directly.

Before initiating legal proceedings, both parties agree to attempt resolution by direct negotiation or, if that fails, by a mutually agreed mediator based in Sangareddy or Hyderabad.

9. Changes to these terms

We may update these Terms from time to time. The version that applies to a given project is the version published on this website on the date the quotation is accepted. For ongoing projects, updates to these Terms do not apply retroactively.

Material changes to these Terms will be indicated by an updated "Last updated" date at the top of this page.
